BRAD CABANA FACING POTENTIAL LEGAL ACTION

A man who sought to replace Danny Williams as leader of the Progressive Conservative Party in 2010  could be facing legal action for defamation. over comments he made about the former Premier's involvement with Alderon Iron Ore Corp.

CBC is reporting that Brad Cabana confirmed that he has been asked by Alderon Iron Ore Corp lawyers, and Danny Williams,  to retract comments he made regarding the financing of the Muskrat Falls project.

This could be interesting to watch.

Cabana evolved from an ardent PC supporter to a Liberal Party of Newfoundland and Labrador leadership candidate over the course of 2011. He has been a vocal critic of the proposed Lower Churchill deal.

Cabana is the author of a local political blog, Rock Solid Politics.

An internet defamation ruling from Ontario’s Superior Court last fall indicates that the courts may be providing more leeway for comments on Political Blogs and message boards. Perhaps this current legal spat over Cabana's comments might  clarify the ground rules for defamation in the context of Internet debates.

What do you think? I know that many people get into the cut and thrust of debate and press send without really thinking about the defamatory nature of their comments. Where does vigorous debate end and libel begin?

"could be facing legal action for defamation over comments he made about the former Premier's involvement with Alderon Iron Ore Corp" is incorrect. Its not about the ex premier's involvement with Alderon. Actually, it has very little to do with Alderon proper at all. That will come out.
Here is a quote from the Supreme Court of Canada for you that I find particularily appropriate:" The court agreed that the traditional law of defamation too greatly favoured protection of reputation, stating that "defamation lawsuits, real or threatened, should not be a weapon by which the wealthy and privileged stifle the information and debate essential to a free society."

THIS I CANNOT UNDERSTAND. WHY IS BRAD CABANA SO INTERESTED IN THE AFFAIRS OF THIS PROVINCE? WHY DID HE THINK HE COULD JUST GET OFF THE BOAT AND TAKE OVER FROM PREMIER WILLIAMS.

Libel chill cools a lot of fair comment unnecessarily. That is what is happening here.
